Request A Hearing After Denial Or Termination Or Decrease In Benefits

If MDHHS takes an action or makes a decision you do not agree with, you can request a hearing. You can use the Do-It-Yourself MDHHS Hearing Request tool to complete your request. Make a copy of the form to keep for your records.

You can fax, mail, or drop off your request in person. If you fax your request, keep the fax confirmation for your records. If you choose to mail your request, you may want to send it by certified mail to have proof of when you sent it. Be sure to direct it to the Hearing Coordinator, not your caseworker.

If you drop off your request, sign the log book in the office lobby . If you have a camera phone, take a picture of your signature in the log book for your records. You could also ask the person who takes the form to stamp your copy as proof of when you dropped it off.

You should request a hearing before the effective action date listed on the notice. The effective action date for Medicaid is always at the beginning of the month. If the person does this, federal law requires their coverage to continue.

An old MDHHS policy required Medicaid hearing requests to be received by MDHHS within 10 days of the notice date. MDHHS changed this policy but has not fixed its computer system. This means people getting Medicaid continue to get notices that require their hearing requests be received in 10 days. If you have had an issue related to this, contact your local legal services office for help. Use the Guide to Legal Help to get their contact information.

Medicaid Income Limits By State 2021

Many residents would say that one of the biggest problems in the United States is the state of healthcare. Not only is healthcare expensive, but not everyone has access to insurance that makes it more affordable. While the Affordable Care Act did help some low-income households, other individuals and families still struggle without healthcare.

One of the nations programs that strives to help low-income individuals have access to healthcare is Medicaid. This federal program allows children, parents, pregnant women, and adults to receive the care they need despite having a low income.

Qualifying for Medicaid varies by state. The primary difference is the income level required to qualify. If you earn too much income, you will not qualify for this federal program and will need to seek other forms of assistance for healthcare.

For this article, were going to look at the income limits by state for parents of one child, as well as other adults. All numbers are based on the Federal Poverty Level, or FPL. The FPL is determined by the Department of Health and Human Services. This number is used to determine who is eligible for programs like Medicaid and other benefits, such as low-income government housing programs and food stamps. This rate is adjusted every year in January based on inflation.

Effective Date Of Coverage

Once an individual is determined eligible for Medicaid, coverage is effective either on the date of application or the first day of the month of application. What Money Does The Government Consider Your Income

The income used to determine Medicaid eligibility is called Modified Adjusted Gross Income . Adjusted gross income is the total of all the money you earned during the year minus any allowable tax deductions. MAGI is your AGI plus any untaxed foreign income, non-taxable Social Security benefits, and tax-exempt interest. According to the federal government, for many people MAGI is identical or very close to adjusted gross income. To learn more about calculating MAGI, use this government resource linked here.

As a general rule, if your income is below 138% FPL and your state has expanded Medicaid coverage, you qualify for Medicaid based only on your income. But check with your state-specific Medicaid program to get specific requirements.

Income And Asset Limits

HMP and each TM category have income limits. Some TM categories also have asset limits. The limits vary depending on the program. HMP programs do not have asset limits.

Income

Income is money you get. MDHHS will look at the money you get from things like:

  • Wages from your job, including self-employment
  • Disability benefits

MDHHS sometimes doesnt count all the money you get as income. For example, if you get SSI, that wont be counted.

Assets

Assets are things you own. Some examples are cash, personal property, and real property. Real property is land and the things on it. Personal property includes investments, retirement accounts, life insurance policies, and trusts. There is no asset limit for TM categories for eligible children, pregnant women, and some families with minor children. Most other TM categories have asset limits. HMP does not have asset limits.
