What Are The Financial Requirements For Medicaid

Medicaid applies both asset and income limits to all applicants. Income includes funds from all sources, such as pensions, rent from income properties, interest or dividends from investments, wages, and Social Security Income. The amount of allowable income changes each year, but it’s always extremely low. For example, in 2022, the monthly income limit for an individual was $934, while a married couple with both spouses applying for Medicaid could have only $1,367 in net income per month.

Assets include any property within your control that could potentially be of value. The 2022 asset limit was $16,800 for a single Medicaid recipient and $24,600 for a couple. Essentially, the government is checking whether you could cover the costs of care out of your pocketeven if it meant selling most of what you own.

It is easy to confuse Medicaid with Medicare. The two programs are not without their similarities. One key difference is that Medicare is a federal program, whereas Medicaid is a state program with rules that vary depending on where you are. The other major difference is that Medicare is based largely on age and disability, while Medicaid is based largely on income.

Depending on your circumstances, you can be on both at the same time. Circumstances is the key word. Medicare tends to be long-term, if not permanent. Medicaid is often a shorter-term solution. There are other programs that are generally associated with Medicaid such as financial and grocery assistance. It is possible that if you have qualified for these other forms of assistance, Medicaid will be included.

A health savings account is a savings tool many use for health qualifying care expenses. It’s a tax-advantaged way to save for future health care costs, and you can use it in retirement. Medicaid Eligibility In Texas

You may be eligible for Medicaid in Texas if you fit the following requirements.

  • You are a legal resident of Texas, i.e., a U.S citizen, legal alien or permanent resident, and need health insurance/care assistance.
  • Your financial situation falls under the low or very low-income bracket.
  • You are responsible for a child who is 18 or younger or blind
  • You are pregnant

Apply For Medicaid In Texas

You can enroll through HealthCare.gov or the state Medicaid website. You can enroll by phone at 800-318-2596.

Eligibility: The aged, blind, and disabled. Also, parents with dependent children are eligible with household incomes up to 15% of FPL. Children are eligible for Medicaid or CHIP with household incomes up to 201% of FPL, and pregnant women are eligible with household incomes up to 198% of FPL.

Uncertainty About The Budgetary Effects

A large source of uncertainty in the estimates is how states would respond to the change in the safe-harbor threshold. The estimate that states would replace half of the lost revenues with other revenue sources or by reducing spending in other areas is highly uncertain. To the extent that the average response by the states would be to make larger cuts to Medicaid, the federal government’s savings would be greater, and to the extent that the average response by the states was to make smaller cuts to Medicaid, the savings would be smaller.

Medicaid Defined: How Does the Program Work?

Background: In August 2021, over 50 organizations sent a letter to Governor Hochul asking her to expand Medicaid eligibility for older adults and people with disabilities in the 2022-23 Executive Budget. These groups were left out of Medicaid expansion under the Affordable Care Act . Lead organizations on the letter included New York Legal Assistance Group, along with Medicaid Matters New York, and other organizations. The letter to Gov. Hochul urged her to expand the income limits for the Medicare Savings Program or “MSP.”

  • NYLAG and the coalition sent a follow up letter to the Governor in December 14, 2021.

Though the Governor’s proposed budget and both one-house bills of the NYS Senate and Assembly all proposed to repeal the asset test. The final NYS SFY 2022-23 budget increased but did not repeal the asset limit. Final enacted bill at A9006-C – See Part AAA Sections 2-4, p. 259 et seq.

WHAT’S NEXT: In Nov. 2022, advocates renewed their request to Gov. Hochul to repeal, or at least expand the asset limit in the SFY 2023-24 Budget.

Chip Income Guidelines For Texas

Texas takes care of childrens health for low-income families residing in the state. Childrens Health Insurance Program or CHIP and Medicaid are the major programs available. CHIP provides health insurance for families who cannot qualify for Medicaid but who cannot afford other health insurance.

Family income is the basis for enrollment and copayment for the CHIP program. Qualifications in 2019 require that a child be under the age of 18, a U.S. citizen or permanent legal resident and a Texas resident. A pregnant woman qualifies at any age to apply for CHIP perinatal services.

South Dakota Medicaid For Certain Newborns

South Dakota children born to women eligible for South Dakota Medicaid are also eligible for South Dakota Medicaid.

Eligibility Requirements

  • The child must be born to a woman eligible for and receiving South Dakota Medicaid on the date of the childs birth.
  • There is no resource or income limit.
  • Coverage continues from the month of birth until the end of the month in which the child turns one year of age as long as the child continues to live in South Dakota.

Effective Date Of Coverage

Once an individual is determined eligible for Medicaid, coverage is effective either on the date of application or the first day of the month of application. Benefits also may be covered retroactively for up to three months prior to the month of application, if the individual would have been eligible during that period had he or she applied. Coverage generally stops at the end of the month in which a person no longer meets the requirements for eligibility.

How To Determine Size Of Household To Identify Which Income Limit Applies

The income limits increase with the “household size.” In other words, the income limit for a family of 5 may be higher than the income limit for a single person. HOWEVER, Medicaid rules about how to calculate the household size are not intuitive or even logical. There are different rules depending on the “category” of the person seeking Medicaid. Here are the 2 basic categories and the rules for calculating their household size.

  • People who are Disabled, Aged 65+ or Blind – “DAB” or “SSI-Related” Category — NON-MAGI – See this chart for their household size. These same rules apply to the Medicare Savings Program, with some exceptions explained in this article.

  • Everyone else MAGI – All children and adults under age 65, including people with disabilities who are not yet on Medicare — this is the new “MAGI” population. Their household size will be determined using federal income tax rules, which are very complicated.

    The Minimum Spousal Share

    The minimum Community Spousal Protected Amount is currently $25,728. This means the spouse can keep a minimum of $25,728 if the couples total combined resources exceed $25,728. If your total combined counted resources exceed $25,728 then your protected amount using the governments rules is 50% of your assets, but no less than $25,728. For exmaple, If you have $50,000 in resources, the spouse would keep $25,728 but the rest of your life savings would face the spend-down.     Elderly Individuals Who Would Require Nursing Home Care If Not For Special Services Performed In Their Home

    Elderly individuals living independently in their own homes may be eligible for South Dakota Medicaid.

    Eligibility Requirements

    • A person must be in need of nursing facility care.
    • A person must not be a resident of a hospital, nursing facility or an intermediate care facility for the mentally retarded.
    • A person must be a resident of South Dakota and meet certain citizenship requirements of the United States.
    • The monthly income limit is 300 percent of the SSI Standard Benefit Amount.
    • The resource limit is $2,000. Resources include items such as checking or savings accounts and certificates of deposit.

    Private Duty Nursing: Nursing services provided by a licensed nursing professional for recipients with chronic and stable conditions who require more individual and continuous care than is available from a part-time or intermittent nursing service.

    Adult Day Care: Services providing out-of-home structured health and social services on a regularly scheduled basis and in daytime settings.

    Texas Has Not Accepted Federal Medicaid Expansion

    What Medical Expenses Qualify For Hsa Plans

    Medicaid: Do I Qualify?

    The IRS allows you to withdraw funds tax-free to pay for qualifying medical expenses. If you are under 65 and use the funds to pay for something that doesn’t qualify, you can expect to pay taxes at your income level on those expenses, plus a penalty. However, if you’re over 65, you will have to pay taxes at your income level, but you won’t get hit with any additional penalties.

    Here are some IRS-approved medical expenses you can pay for from your HSA:

    • Ambulance and hospital services
    • Improvements made to your home to help accommodate disabilities, such as ramps, widening doorways and safety railings
    • Chiropractor visits
    • Eye exams, contact lenses and glasses
    • Medicare Parts A, B and D premiums
    • Qualifying long-term and nursing care
    • Smoking and alcohol programs
    • Transportation to and from medical care

    In most cases, you can use HSAs to pay for qualifying medical expenses for yourself and those in your family, such as your spouse or children, as long as limitation rules don’t disqualify them.

    Caution: What Is Counted As Income May Not Be What You Think

    For the NON-MAGI Disabled/Aged 65+/Blind, income will still be determined by the same rules as before, explained in this outline and these charts on income disregards. However, for the MAGI population – which is virtually everyone under age 65 who is not on Medicare – their income will now be determined under new rules, based on federal income tax concepts – called “Modifed Adjusted Gross Income” . There are good changes and bad changes.

    GOOD: Veteran’s benefits, Workers compensation, and gifts from family or others no longer count as income.

    BAD: There is no more “spousal” or parental refusal for this population and some other rules. For all of the rules see:

    What To Do If You Don’t Qualify For Medicaid

    If you don’t qualify for Medicaid, you can possibly get subsidized health care through the Obamacare marketplaces during a special enrollment or open enrollment period. Americans who making more than 100% of the FPL qualify for a premium tax credit that can significantly lower the cost of a plan.

    Federal open enrollment for 2022 health care plans runs until Jan. 15, 2022, though some state exchanges are open longer. Learn 2022 open enrollments dates by state. Healthcare.gov, the federal exchange, usually opens from November 1 to December 15 each year.

    If you can’t find affordable health care on your marketplace during open enrollment, you have a few back-up options.

    These include:

    Short-term health insurance: Originally designed to prevent short-term health insurance gaps, these plans are cheaper, but much less comprehensive than traditional coverage. They don’t have to cover Obamacare’s 10 essential benefits or pre-existing conditions. Following changes by the Trump administration, short-term health plans can last from three months to potentially three years, though som estates have stricter limits.

    Limited benefit plans: These plans cover a very small portion of the costs associated with certain “medical events,” like a doctor’s visit or ambulance ride. Both the number of events and dollar amounts covered are capped.

    Prescription discount cards: While these cards won’t help you pay for inpatient or outpatient care, they do help you get medication at discounted rates.

    Prescription Drugs With Medicaid In Texas

    Most prescription drugs are covered. People 20 and under get unlimited medicines. All others are limited to three medicines per month. Prescriptions that help you quit smoking are not counted in that limit. Some medicines will need to be pre-approved. The pharmacist will take care of this, and will provide a 3-day supply pending approval.

    Medicaid For Children And Adults

    Eligibility for Medicaid and Dr. Dynasaur are based on the current year Federal Poverty Level guidelines.

    • The monthly income limit for adults ages 19 through 64, who are not blind or disabled, is 138% FPL.
    • The monthly income limit for children under age 19 is 317% FPL. . There is a monthly premium for some households based on your income. For families up to 195% FPL, there is no premium. There are no prescription co-payments.
    • The monthly income limit for Vermonters who are pregnant is 213% FPL. Dr. Dynasaur for pregnant women provides the same coverage as Medicaid, plus full dental coverage. There are no premium or prescription co-pays with this type of Dr. Dynasaur.
