What Is A Qualified Income Trust

The Qualified Income Trust was designed to address the growing disparity between Medicaid caps and the high cost of long-term care for the elderly. It allows you to legally divert income into a Trust, reducing the amount of your income that gets counted against Medicaid caps.

A QIT is a special type of trust for seniors in need of long-term care whose income exceeds Medicaid caps. A trust allows a third party to hold assets on behalf of a beneficiary.

Here, you set up a special account for the Trust which will receive the income necessary to make sure the applicant falls under the income eligibility limit. You deposit income to the Trust, and the Trust then directs how funds are dispersed each monthcommon disbursements of Trust funds include:

  • A small personal needs allowance .
  • Medical expenses not reimbursed by Medicaid.
  • Minimum Monthly Need Amounts to a spouse, if applicable.
  • Lastly, a nursing home co-payment.

Once the QIT is established the State will determine how much of your remaining income will be used to contribute to your long-term care as a co-pay, or applied income amount.

Medicaid is considered a payor of last resort, so a Medicaid recipient is generally going to pay everything they have first and Medicaid will pay the difference. As with the fund, you are allowed a small personal needs allowance and a contribution toward a spouses MMNA. Upon death, the State becomes the beneficiary and uses any remaining funds to recover against Medicaid benefits paid out.

HHSC provides health care coverage for individuals living in Texas who aged out of foster care under an ICPC agreement. This includes both individuals placed by the Texas Department of Family and Protective Services in foster care in other states and individuals placed in foster care in Texas from other states.

Right To Remain With Chosen Service Provider

A service provider may not transfer or discharge an elderly person unless:

  • the transfer is for the persons welfare, and the persons needs cannot be met by the service provider
  • the persons health is improved sufficiently so that services are no longer needed
  • the persons health and safety or the health and safety of others would be endangered if the transfer or discharge was not made
  • the service provider ceases to operate or to participate in the program that reimburses the service provider for the persons treatment or care or
  • the person fails, after reasonable and appropriate notices, to pay for services.

Except in an emergency, a service provider may not transfer or discharge an elderly person from a residential facility until 30 days after the service provider gives written notice to the person, the persons legal representative, or a member of the persons family stating:

  • that the service provider intends to transfer or to discharge the person
  • the reason for the transfer or discharge
  • the effective date of the transfer or discharge
  • if the person is to be transferred, the location where the person will be transferred and
  • the persons right to appeal the action and to whom the appeal should be directed.

In an emergency, , a resident could be transferred to a hospital or another appropriate place for treatment without notice or a hearing.

Medicaid For Texans In Assisted Living Facilities

Assisted living facilities provide food, personal care services like help with bathing or dressing, and medication administration. Historically, Medicaid did not pay for ALFs. However, Texas has a program offering Medicaid payment for assisted living facilities, if you meet specific criteria.

If you are otherwise eligible for Medicaid and if you can show that a nursing home is medically necessary for you , then you may qualify for STAR+PLUS Waiver services. This program pays for home- and community-based services, including assisted living facilities, for people who would otherwise have to be institutionalized in a nursing home.
