Expanded Medicaid Coverage In New York Mental Health Services
In December, 2021, New York Governor Kathy Hochul signed two new bills into law which will greatly expand coverage under the States Medicaid program.
The first new law, which will take effect on March 21, 2022, will amend the New York Social Services Law to provide that the care and services provided in New York by licensed clinical social workers will be eligible for coverage under the Medicaid program. Once the law is effective, licensed clinical social workers will be able to bill Medicaid directly for their services within their scope of practice. Licensed clinical social workers in New York have a broad scope of practice in the State and are authorized to practice mental health counseling, marriage and family therapy, creative arts therapy, and psychoanalysis. As a result, this new law should assist in greatly broadening access for individuals to critical mental health services across the State especially at this critical time when so many individuals have been adversely impacted by the COVID-19 pandemic.

The New York State Office of Mental Health offers primary care providers a unique opportunity to implement the Collaborative Care model and receive reimbursement for services provided. Practices must apply to OMH and be accepted into the Collaborative Care Medicaid Program before becoming eligible to use the Medicaid rates for reimbursement. Program participants must be able to demonstrate that they are following the evidence-based best practices of CoCM, and that they are able to report evaluative data to NYS OMH. Approved CCMP sites are eligible to bill the Collaborative Care case rate for any Medicaid patient receiving CoCM depression or anxiety treatment.

Effective September 1, 2022, MMC Plans will deny payment to unenrolled pharmacies, other unenrolled practitioners, and providers for services provided and/or prescribed. Providers servicing MMC members should, without delay, begin the enrollment process and complete all required forms, including certifications.
Please note: The enrollment requirement is applicable only to enrollable provider types including pharmacies and most licensed practitioners. Non-enrollable provider types must not be terminated from MMC networks for failure to enroll in NYS Medicaid. On May 18, 2022, the Medicaid Update published a Special Edition issue which outlined the implementation of the New York Independent Assessor for personal care services and/or consumer directed personal assistance services .
