Prescribers For Medicaid Members Must Register With West Virginia Medicaid

On and after October 17, 2018, West Virginia Medicaid will begin to deny all claims for prescriptions written by any prescriber not enrolled with West Virginia Medicaid. This includes hospital residents and interns, advanced practice nurse practitioners, physician assistants and pharmacists who administer vaccines. Even though the facility you are employed by is currently enrolled, individual prescribers must also be enrolled. Failing to enroll with West Virginia Medicaid as a prescribing provider could cause serious consequences for your patients.

The requirement for prescribers to enroll is a provision of the Patient Protection and Affordable Care Act of 2010. All prescribers serving Medicaid patients MUST enroll and their name and national provider identifier must be recorded on claims for prescription medications submitted for Medicaid members on and after October 17, 2018. Providers may enroll as a billing provider or an ordering, referring, or prescribing provider.ORP only provider is a category for prescribers who write orders, refer, or prescribe medications, but do not actually submit claims to Medicaid for their services. ORP only providers may not bill Medicaid for services.

To prevent interruptions in Medicaid members access to needed prescription medications, prescribers must make sure they are enrolled with West Virginia Medicaid.

Your communication to CMS on March 23, 2020, detailed a number of federal Medicaid, the Childrens Health Insurance Program , and Medicare, requirements that pose issues or challenges for the health care delivery system in all counties in West Virginia and requested a waiver or modification of those requirements. Attached, please find a response to your requests for waivers or modifications, pursuant to section 1135 of the Social Security Act, to address the challenges posed by COVID-19. This approval addresses those requests related to Medicaid, CHIP, and Medicare.

To streamline the section 1135 waiver request and approval process, CMS has issued a number of blanket waivers for many Medicare provisions, which primarily affect requirements for individual facilities, such as hospitals, long term care facilities, home health agencies, and so on. Waiver or modification of these provisions does not require individualized approval, and, therefore, these authorities are not addressed in this letter. When Can I Enroll In Medicare

There are certain times that you can enroll in Medicare and Medicare Advantage plans. Well discuss these different enrollment periods next.

Your initial enrollment period starts 3 months before your 65th birthday, extends through your birthday month, and continues 3 months after you turn 65 years old. If you wait until your birthday month or later, the start date for your coverage will be later.

There are other enrollment periods that take place a certain times each year, including:

  • Medicare open enrollment is when you can make changes to your original Medicare coverage or switch between Medicare Advantage and original Medicare plans.
  • Medicare Advantage open enrollment is when you can make changes to your plan if you are already enrolled in Medicare Advantage. You can also drop your Medicare Advantage plan and switch back to original Medicare during this time.
  • General enrollment period is when you can sign up for Part A and Part B if you didnt sign up during your IEP. You may have to pay a late enrollment penalty if you missed your IEP.

Special enrollment periods allow you to enroll in Medicare outside of the usual enrollment periods if you lose coverage for a qualifying reason. You may have up to 8 months to enroll in coverage after the qualifying event.

As of late 2017, West Virginias Department of Health and Human Resources was considering the possibility of seeking a waiver from the federal government in order to implement a work requirement for the states Medicaid expansion population. Legislation to create a work requirement was considered in the 2019 legislative session, but it was criticized by consumer advocates and did not advance to a vote.

Although work requirements were a non-starter with the Obama administration, the Trump administration approved them in several states. But the work requirements were either overturned by judges or suspended due to the COVID pandemic, and all of the approved work requirement waivers have been revoked by the Biden administration.

Previous And Current Governor Support Medicaid Expansion

West Virginias former Governor, Earl Ray Tomblin, was instrumental in West Virginias acceptance of Medicaid expansion but was term-limited and could not seek re-election in 2016.

Governor Jim Justice took office in January 2017. He campaigned and was elected as a Democrat, but in the summer of 2017, during his first year in office, he switched to the Republican party. Justice reiterated his support for Medicaid expansion in the weeks leading up to his party switch, stating in late June 2017 that it would be beyond catastrophic if the people who had gained coverage under Medicaid expansion were to lose it. But Justice also vetoed a supplemental appropriation for the states Medicaid program in 2019, saying that the Medicaid program already had enough funding.

The opioid crisis has hit West Virginia particularly hard, and the state has the nations highest drug overdose death rate.
