We authorize pharmacies to provide up to a 30 day supply of medication for an emergency fill when a licensed pharmacist has used his or her professional judgment in identifying that there is an emergency medical condition for which lack of immediate access to pharmaceutical treatment would result in, placing the health of the individual or, with respect to a pregnant woman, the health of the woman or her unborn child, in serious jeopardy serious impairment to bodily functions or serious dysfunction of any bodily organ or part.

Kroger Safeway Strike Back Against Walmart/humana Part D Drug Plan

MINNETONKA, Minn. Could the economy and the bare-knuckles competition that now defines pharmacy retailing lower the price bar even further for widely used generic drugs? Its already happening.

Walmart upended the low-price end of the pharmaceutical market four years ago when it launched a widely imitated, much-publicized blanket price point of $4 for many of its generic prescription drugs. Over time, $4 has become the de facto price standard for multisource generics at many outlets. But two major developments in recent weeks threaten to upend the uneasy status quo that has existed in prescription discounting over the past two or three years.

Ironically enough, Walmart itself is the source of the new upheavel. In late September, the company announced a new, steeply discounted prescription drug plan to serve seniors enrolled in Medicare Part D. The plan, launched in partnership with insurance provider Humana and marketed as the Humana Walmart-Preferred Rx Plan, will offer enrollees monthly premiums below $15 and co-payments as low as $2 on some generic prescriptions.

First to fire back directly are two of the nations biggest supermarket chains. In late November, Kroger and Safeway announced the launch of a new, low-price prescription plan for Medicare Part D beneficiaries, in partnership with UnitedHealth Group.

Safeway Administering Special Senior Flu Shots

All Safeway pharmacies in the United States are able to administer a new high-dose flu vaccine called Fluzone High-Dose that has been approved by the Food & Drug Administration for use in people 65 years of age and older.

Although adults over 65 make up 15 percent of the U.S. population, they account for 65 percent of flu-related hospitalizations and 90 percent of flu-related deaths, making flu vaccines for this age group critical. Fluzone High Dose contains the same components as regular-strength flu vaccine but provides a better immune response in older people.

The Pleasanton, Calif.-based grocer, which operates 1,712 stores in the United States and western Canada, is offering the vaccines on a walk-in basis at its Safeway, Vons, Pavilions, Carrs, Dominicks, Genuardis, Randalls and Tom Thumb pharmacies while supplies last. Stores without pharmacies will hold scheduled flu vaccine clinics.

Consumers can find information about stores offering the flu vaccine at www.safeway.com/flu or by contacting a Safeway pharmacy. Those covered by Medicare Part B will receive their flu shots free.

Jacksonville, Fla.-based Winn-Dixie is also offering the high-dose flu vaccines in its 379 in-store pharmacies in Florida, Alabama, Louisiana, Georgia and Mississippi.

    As mandated by the legislature in RCW 74.09.490, the Health Care Authority developed the second opinion program to improve prescribing practices in children.

    In collaboration with The Pediatric Mental Health Advisory Group and the Drug Utilization Review Board, HCA established pediatric mental health guidelines to identify children who may be at high risk due to off-label use of prescription medication, use of multiple medications, duplicated therapy, high medication dosage, or lack of coordination among multiple prescribing providers.

    The HCA requires a review by an agency-designated mental health specialist from the Second Opinion Network when drugs used to treat mental health conditions are prescribed outside of the established guidelines set by the pediatric childrens mental health workgroup.

    The Defendant alleges that the allegations of the Relator, Thomas Proctor, are substantially similar to a previously filed qui tam complaint that was reported in the news media before the amended complaint was filed and, therefore, the amended complaint must be dismissed on the grounds of the public disclosure bar and the original source requirement.

    Safeway states that Tiffany Huckels, a former pharmacist at its pharmacies in Colorado, filed a qui tam complaint against Safeway in Colorado state court on August 5, 2014. On or about March 13, 2016, after the complaint was unsealed and the case was removed to federal court, the legal news website Law360 reported and linked to the action. The amended complaint in this case was filed on March 31, 2016.

    To determine whether the public disclosure bar applies, courts employ a three-step analysis. See United States ex rel. v. Wisconsin Bell, Inc., 760 F.3d 688, 690 . The Court first “examines whether the relator’s allegations have been publicly disclosed.” Id. . “If so, it next asks whether the lawsuit is based upon those publicly disclosed allegations. If it is, the court determines whether the relator is an original source of the information upon which his lawsuit is based.” Id.

    The Defendant also contends that Relator Proctor does not qualify as an original source for the allegations in the amended complaint. The FCA defines “original source” as an individual who either:

    If you take a drug on a regular basis and are planning to travel, be sure to check your supply of the drug before you leave. When possible, take along all the drugs you will need. If you travel within the United States and territories, we may cover your drug at an out-of-network pharmacy for the same reasons as noted above. However, we cannot pay for any prescriptions filled by pharmacies outside of the United States and territories, even for medical emergency.
