If you recently received a denial on your application for New York Medicaid benefits, you probably have a lot of questions.

A Medicaid denial is a nerve-wracking experience, especially when you are not sure why you received it in the first place. Here are some potential reasons why Medicaid denied you and what you can do about it.

When A State Can Recoup Benefits

After the Medicaid recipient dies, the state can try to recoup whatever benefits it has paid out. The home is usually the only major claimable asset. Currently, the state can only put a lien on it if it is part of the deceased’s probate estate. If the asset is jointly owned with a spouse or in a life estate or trust, then it can escape recovery.

In most states, the government can place a lien on the home after the death of both spouses, unless a dependent child resides on the property.

    How Your Assets Impact Eligibility

Besides income, your assets will be counted toward meeting eligibility requirements. Countable assets include checking and savings account balances, CDs, stocks, and bonds.

In most states, you can retain up to $2,000 as an individual and $3,000 for a married couple outside of your countable assets. However, these amounts may vary depending on the state in which you live.

Your home, your car, personal belongings, or your savings for funeral expenses remain outside of countable assets. If you can prove other assets are not accessible , they too are exempt. A house must be a principal residence and does not count as long as the nursing home resident or their spouse lives there or intends to return there.

Upon becoming eligible for Medicaid, all of the applicant’s income must be used to pay for the nursing home where the applicant resides. However, you may be allowed to keep a monthly “allowance” and a deduction for medical needs, such as private health insurance. The amount of the allowance varies depending on your living arrangements, type of nursing facility, and state rules. If you are married, an allowance may be made for the spouse still living in the home.

    Nursing Home / Institutional Medicaid

Some of the things that Ohio Medicaid wont cover in a nursing home are a private room, specialized food, comfort items not considered routine , personal reading items, plants, flowers, and any care services not considered medically necessary.

Any Ohio Medicaid beneficiary who receives Nursing Home Medicaid coverage must give most of their income to the state to help pay for the cost of the nursing home. They are only allowed to keep a personal needs allowance of $50 / month. This can be spent on any personal item clothes, snacks, books, haircuts, cell phones, etc. It can not be spent on any item that Medicaid covers, including hygiene basics like toothbrush, soap, deodorant, razors and incontinence supplies, unless the Medicaid beneficiary wants a specific brand that is not covered by Ohio Medicaid. In this case, they could spend their personal needs allowance on the item.

How To Apply / Getting Started

Every State has an agency that is in charge of administering the Medicaid Applications within that state. The Florida Department of Children and Families is the agency that administers the application process in Florida.

Eligibility for Medicaid for long-term care services, Nursing Home Medicaid, and Medicaid programs that provide for Assisted Living Facility or at home assistance all have the same financial requirements that must be met. Both husband and wife will need to provide documentation regarding assets and income as part of the application process. I know this seems like a violation of our right to privacy, but the Congress and Senate have not yet made it a right for everyone to receive Medicaid Long Term Care. Medicaid qualification for Long Term Care is optional and available for those who choose to apply and are willing to provide the necessary documentation to prove they meet the requirements. The basic financial requirements are that an individual receives less than $2,313/month income and has less than $2,000 in assets. For a couple, the community spouse may retain $126,420 for what is called a resource allowance, and the community spouse income is unlimited. That is the basic Financial Standards for Medicaid Institutional Care Program , which covers Long Term Care. These standards DO NOT APPLY to any other Medicaid program.

How Do I Appeal A Denial

If you want to appeal your Medicaid denial, you should identify whether it came from a local office or the New York State of Health. You can submit an appeal for a fair hearing online, over the phone, via fax or in writing, but you need to request the hearing within 60 days of receiving your denial notice. At the hearing, you must present evidence to support why you think your application deserves approval. An administrative law judge will hear your argument and approve or deny your appeal.

A Medicaid denial is discouraging, but do not lose hope. You can appeal the decision if you believe your application denial was an error.

Medicare Vs Medicaid Roles In Nursing Home Care

Medicare does cover nursing home careup to a point. If you are sent to a skilled nursing facility for care after a three-day inpatient hospital stay, Medicare will pay the full cost for the first 20 days. For the next 100 days, Medicare covers most of the charges, but patients must pay $185.50 per day unless they have a supplemental insurance policy. For day 101 and beyond, the patient pays all costs.

These rules apply to traditional Medicare. People on Medicare Advantage plans likely have different benefits

Some nursing homes wont accept Medicaid patients outright, but the law forbids them from throwing you out if you become dependent on Medicaid when you are in their care.
